The below is rich considering the writers ongoing behaviour and on investigation absolute nonsense but serves as another shining example of your UTASA chairman’s pompous arrogance and provocative shenanigans and abuse of perceived power. Clearly from the contents of Terblanche’s letter Pel makes a habit of defaming people and I am not alone.
Let no one be confused as to where I am going with all of this, especially not you who should know me well after working together with me for so long. This sort of behaviour from your chairman can no longer simply be overlooked.

As per our telephonically conversation on May 10, 2010 regarding Mr Etienne Pel Five Star Towing. (in Pretoria)
One of my accident runners stood on an accident scene on May 9th 2010 where Mr.Oberholzer driving a Ford Focus Reg. no.DCM 259 MP where involved in an accident. My Driver asked the client with whom he is insured with and he said Santam.He said to my driver to phone the number on the side of the vehicles window to get authorization. My Driver then phoned the number and got thru to International S.O.S, he asked the call taker Gregory if anyone logged the call for towing the client’s vehicle, his answer was no not yet. At that time Nedcare 911 arrived on the scene and said to my driver to move the vehicle because they are standing on dangerous spot.
My Driver then said to the client that he has to move his vehicle to a save spot. The client then asked my driver if we are approved with Santam. My Driver then said to the client not to worry because he has logged the call and that we are approved with them. After towing the vehicle the client received a call from Mr.Pel asking the client where his at. The client then said to Mr.Pel that his been assisted by Centow Roadside Assistance.Mr.Pel then said to the client that we aren’t authorized to tow the vehicle and that we need to off hook his vehicle.
The client then said to Mr.Pel that he doesn’t have to worry and that he is on his way home.Mr.Pel then said to the client that we are a bunch of thieves and that we charge ridicules towing fees and that the client will be liable for the towing. My Driver then took the telephone from the client and asked Mr.Pel why his telling the client that we are thieves.Mr.Pel told my Driver that he doesn’t want to speak to him and ended the call.
I received a call form Mr.Pel at 01H10 on Sunday morning May 9 2010.Mr.Pel said to me that one of my drivers just towed a vehicle with out authorization and that I have to phone my driver to off hook the vehicle. I then said to Mr.Pel to please phone me a bit later because I’m still sleeping and that we will sort it out in the morning. With an aggressive manner Mr.Pel then said to me that he will sort this out with Santam and just hanged up the phone. I tried to phone him back but he refused to answer.
We did received a reference number form S.A.T.R.A about 30 min after assisting the client SSP 143 001 3359 whilst Mr.Pel made this huge commotion.
I phoned Mr.Pel on May 10 2010 to speak to him about this matter. He said to me that he will take this up with Santam and make sure they take towers like me of the panel.I then asked him why his telling the clients that we are thieves. He said to me he never did, the client where standing in my office and confirmed that he did and is willing to testify that he did.
Now I wonder how the hell this Mickey Mouse Tower Mr.Pel with his 1 Sling and 3 Rollbacks are to do this. This person doesn’t even have a proper office or towing yard. He is working from home trying to rule the towing industry. It’s people like this that gives towing a bad name stirring things up with Insurance companies and with the Government.
I would appreciate it if you will look in to this mater and give me feed back a.s.a.p.

I refer to your call this morning, 10 May 2010 at 11h14.
As you are aware, there was an accident on Saturday night/ Sunday morning on Botha avenue at the N1, where a Ford Focus, belonging to Mr Oberholzer, was involved. The client contacted SANTAM Multi-SOS who then appointed our company, Five Star Towing to uplift the said vehicle.
At no stage ever, was Centow authorised by Godfrey from SANTAM Multi-SOS as suggested by your driver, Barend. Recordings available from SANTAM Multi-SOS.
Nevertheless, your threatening statements this morning and shouting at me; “ luister ballas “, is unprofessional. Threatening me by telling me I should not get into your “ black book “, is laughable.
I would suggest that in the interest of professionalism in our industry, that you would instruct your personnel to take a more honest approach and not mislead customers. Please note that ALL these conversations pertaining to this specific incident is recorded at SANTAM. Furthermore, neither you nor I have the right to inform a client that their Insurer WILL pay. If the insurer decides to repudiate the claim for whatever reasons possible, and where you were NOT authorised to tow the vehicle, who will you hold liable for your release fees?
I trust that this will not happen again and that you will respect the decision of the Insurer at the time of authorisation.

The spotlight of recent has been focused on the Towing & Recovery Industry. The unfolding events have been publicized by the media via television and the local and national newspapers. This hitherto unheard of organization, the Kwa-Zulu Natal Towing Fraternity clearly formed and populated by those including the UNITED TOWING ASSOCIATION of SOUTH AFRICA (UTASA) against whom an Urgent Interim Interdict was granted in the KZN High Court Durban to prevent their continuing campaign of violence, intimidation, damage to property, property invasion kidnapping etc. has brought further and unnecessary limited focus and disrepute to an industry already burdened with a rotten reputation.
The contemptible arrogance of presumption that 2 minutes on a local radio station, a mention on page 5 of a local newspaper 30 seconds on the 22h30 NEWS on etv documenting their boorish behaviour, hardly constitutes “The spotlight” the author of this document alludes to and must be discarded with the disdain it deserves.
What this limited coverage serves to highlight is the ineffectual lengths this bunch of misguided miscreant delinquents will go to in an effort to force themselves and their lost cause and criminal behaviour into the limelight to the detriment of those in the towing industry who do an honest days work for fair return.
The local Towing and Panel Industry has been experiencing financial problems in terms of the towing rates and volume of repairs, distribution and allocation of work and the monopolizing of towing/call centres by major groups. This intern has made a negative impact on the Panel Beating industry as FAM directs tows to a common delivery point, to the determent of all other Panel shops.The very behaviour displayed towards a small local towing competitor, I-way, that caused the interdict encapsulates why big business and other legitimate stakeholders are forced to use “towing/call centres” in an attempt to protect their clients from predation by the many “vultures” who prey on such clients when embroiled in the trauma of a motor vehicle accident and therefore unable to make informed decisions in their own best interests at such time.
We have also been forced into a position whereby we have to accept negotiated rates set by call centres on behalf of the towing industry without consulting the Industries players. Call Centres such as FAMIAA, Europe Assistance, lzinga Assist SOS International, Global Choices, Outsurance and numerous others have been involved with the negotiation of the price fixing process. We have been in consult with the Competition Commission Board regarding these practices and are awaiting a response.The lie is patent! None of the falsely aggrieved were forced into any agreements but were offered contracts at rates and were and are free to accept or decline participation at the rates. Indeed many of those in this KZNTF clique beat a hasty path to those proposing the contracts offering even better rates than those contracted for in an effort to gain a lions share of the work to the exclusion of their cohorts!
Further supporting the foregoing is the approach made to many of the above mentioned Insurers by the Vice-chair of another opportunistic KZN towing faction, the Natal Towing Association (NTA) offering their members services at R1500.00 per tow i.e. a third less than those demanded herein.

Competition Act no. 89 of 1998,
CHAPTER 2, PROHIBITED PRACTICES,
PART A – Restrictive Practices prohibits
(1) an agreement between, or concerted practice by, firms, or a decision by an association of firms, if it is between parties in a horizontal relationship if it
(a) substantially prevents or lessens competition in a market or
(b) involves the restrictive horizontal practice of
(i) directly or indirectly fixing a purchase or selling price or any other trading
condition;
(ii) dividing markets by allocating customers, suppliers, territories, or specific
Types of goods or services; or
(iii) collusive tendering
all of which conversely shows the KZNTF are clearly at risk of falling foul of the Act by their actions and representations contained herein.
All major Towing and Panel Beating companies have however in the interim met regarding these issues and have unanimously agreed to the following rates and procedures which we forward to the table.This paragraph further compounds their breach of
Competition law and risk of successful prosecution for the same, all of which is extremely reckless but typical behavior by this clique.
If a Towing or Panel Beating Company meets your standards and criteria, then there should be no reason for them to be on your panel. Again typically thoughtlessly embarassing!
All existing contracts Call Centres/Insurance Companies that Towing Companies have signed will now become null and void.
Tow bills will be as follows:
1st tow 2nd tow
R2250.00 + vat (accident rate) R 450.00 + vat (accident rate)
Sling Trade rate R550.00 + vat (within 20km radius)
(Thereafter R6.50 + vat per km)
Rollback Trade rate R750.00 + vat (within 20km radius)
(Thereafter R7.50 + vat per km)
Storage at R150.00 per day + vat Salvage at R112.50 per 15min + vat
Any additional equipment required in order to complete a salvage, costs will be added accordingly and proof produced.
Tow bills will be paid on delivery, on drop off point. No free day's storage.
No reference numbers will be accepted as payment.
Unless instructed by owner of vehicle, it will be onus of tow operator to deliver vehicle to a Factory I Insurance approved shop for repair (where relevant).
We will not entertain violence as this is not a war .. All we expect is fair business, peace and harmony, shared evenly amongst our industries. Their actions to date prove the contrary and are falsely magnanimous in the face of the interdict brought against “the clique”

Hi Andre
Tow operators are like vultures ! This may be the opinion of some however it is necessary for me to comment to an incident a few nights ago when my 20 year old son from Durban was involved on an accident in the Randburg area. The accident happened around 23H15 and my son immediately phoned me to assist.
Living 5 minutes away I was surprised to find one of your member companies on the scene when I arrived. They were not only paying attention to the vehicle but also expressed concern about my boy. The tow operator had a female assistant with him and this was especially helpful around a distressed 20 year old. I am pleased to say that I left the vehicle with the operator who waited for the rollback to arrive, did the load, stored the the vehicle and delivered it to the panelbeater of my choice the next morning. For their help and service a big thumbs up to A1 ASSIST.
You guys were great. A special thank you, to you as well. I couldn’t believe the speedy response I got after phoning you the morning after the accident and your personal attention being given to my queries was great.

I'd jus like to say thanks to satra for their assistance last friday. I am a single female student and was on my way back from campus when jus stalled at an intersection. Dear Andre,
My son and I were involved in an accident with a jackal last Friday evening whilst we were returning from the Cape to Pretoria, just before Colesberg. I did not know who I am insured with, but remembered Guardrisk. I called Vodacom’s roadside assistance who put me through to some company as well as Santam etc. The one gentleman told me that I would have to put down a deposit of R2,000 per credit card if I required a tow-in. I explained that I was covered by insurance and that I was standing next to the N1 at midnight and I was very concerned about the safety of my son and myself. I was told by all that I spoke to that they were unable to assist me. Eventually I got through to SATRA. SATRA went the extra mile to get me assistance which no one else bothered to do and I wanted to inform you of the goodness of your Call Centre Operator, who understood that I was a woman standing next to the road at midnight (without R2,000) and contacted Auto Aid in Colesberg that was prepared to come and assist me with the tow-in. My insurance will be paying him in full.
If it wasn’t for SATRA’s assistance we may not ever have made it home as the SATRA agent put life above money and used initiative to assist us in our time of crisis. If only all the emergency companies were like SATRA, fewer people would be getting into life threatening situations in this country.

B1518 Tow Trucks Contract Period 24 Months
A heavy duty tow truck capable of moving heavy vehicles over 2 tons and a light duty tow truck for light vehicles under 2 tons shall be available full time for assistance.
The heavy duty tow truck shall be able to remove broken down heavy vehicles off the roadway or to locations as directed by the traffic authorities. It shall be on the site, preferably parked at one of the interchanges, from 05:00 to 09:00 and from 15:00 to 19:00 in the morning and afternoon respecively from Monday to Thursday. For Fridays, the same hourly requirement shall apply except that the afternoon peak hour shall commence at 13:00. For the remainder of the weekdays, on weekends and holidays the heavy duty tow truck can be parked at the yard of the operator, but it shall be available full time (24 hours) for the exclusive assistance on this contract.
The light duty tow vehicle shall be full time on the site (24 hours) from Monday to Sunday, and shall be parked preferably at one of the interchanges. This light duty tow truck will have the first choice of removing light vehicles.

Hierdie is nie n moeilike saak om te hanteer nie, dit het ons al baie gedoen, ons ken n ongelukstoneel, ons weet waardeur n mens gaan as sy veilige ruimte skielik verfrommel word. Instinktief gee ek n paar vinnige opdragte aan ander personeel, ongeluk, bel die Polisie, Ambulansdiens, Verkeersdepartement! Ongeluk, een voertuig, N1 suid, 15 km, beserings! Die operateur in die insleepvoertuig herhaal die gegewens vinnig en korrek oor die radio en toe hy se, "Whisky Sierra 2 vertrek" daal daar n rustigheid in my want ek weet binne n paar minute sal daar iemand by hierdie vrou wees wat weet hoe om haar te kalmeer, by te staan en die nooddienste te ondersteun. Nadat alles afgehandel is, rapporteer die insleepoperateur aan my en wat alles op die toneel gebeur het. Later dink ek terug aan die vrou en voel lekker diep binne my want ek weet, ek het vandag iemand in werklike nood, angs, pyn en onsekerheid bygestaan. Dit is in hierdie noodsituasies waar die insleepbedryf sy rol speel, net hy kan dit doen en niemand anders nie! ..partykeer is dit n baie ondankabre rol! SATRA welcomes all to our new website in celebration of our 21st birthday, firmly believing this website heralds a new dawn for the towing industry and will be the catalyst for the manifestation of SATRA’s vision of “ the towing industry as a world class participant in the South African economy”
This newsite has been split into two separate sections, the SATRA MOTORIST chapter specifically geared to the consumer of towing and related services, and the SATRA MEMBERS chapter dedicated to towing industry specifics.
We could not marry our original and purely member oriented website, to SATRA’S newsite, due to the incompatibility of the old and new technologies used in the development of the two sites, and are now applying the latest technology and design mastery of our dynamic webmaster to bringing the members’ chapter of our website the same excellence evident in the SATRA MOTORIST chapter, in the near future.
Until then we invite all interested parties to participate jointly in what is presented to you today and enjoy contributing and watching as this website and the towing industry at large matures beyond SATRA’s 21st birthday and on into the new century.
With the addition of this superb new tool to SATRA and the towing industry’s inventory the sky is no longer the limit as towing strides confidently across cyberspace, breaching boundaries and breaking the chains of reputation that bind us to the image of “vultures” in the public eye, for we are not that, we are much more, bringing relief, safety and security to stranded and distressed motorists and their kith and kin- wherever they may be, whenever they may need help, night or day, rain or shine, towers are there to help.
